Regulatory requirements focused on product substance content and the need to provide data regarding ever growing lists of regulated substances are becoming increasingly common in markets all over the globe and failure to comply can prevent entry of your products into those markets.

Understanding the regulatory requirements that may affect your product is critical and should begin the minute you decide to introduce a new product into your existing markets or expand into new markets.  While many regulations in many jurisdictions are similar none of them are exactly the same.  Differences may include:

  • Substances regulated
  • Threshold amounts (may be no de minimus)
  • Data requirements
  • Testing requirements
  • Timing of notifications/registrations
  • Categories of products covered
  • Consumer warnings/safety notifications
  • Labeling requirements
  • Reporting requirements
  • Enforcement mechanisms and policies.

Do not assume compliance with a regulation in one market will be sufficient for compliance with a similar regulation in a different market.  Understanding the regulations that can affect your ability to market and sell your products in a particular market is a critical compliance issue.
