Issue: Application 10 used and part is a Legacy Spare Part
Application Code 10 Vulcanising agent and stabiliser for elastomers in fluid handling and powertrain applications is used. This application code covers three ELV, Annex II exemptions: 7(a), 7(b), and 7(c). All of those exemptions can only be used for Legacy Spare Parts and each of the exemptions has a different exipiry date. This makes using Code 10 correctly a bit of a challenge. You may or may not be able to use Code 10 depending on the following factors:
- the amount of Pb present in your material;
- what the Pb is used for in the material;
- what type of part the material is used in; AND
- the status of your part: New or Legacy.
| Exemption | ELV Annex II Exemption Language, Scope & Expiry Date |
| 7(a). Vulcanising agents and stabilisers for elastomers in brake hoses, fuel hoses, air ventilation hoses, elastomer/metal parts in the chassis applications, and engine mountings | As spare parts for vehicles just on the market before 1 July 2005 |
| 7(b). Vulcanising agents and stabilisers for elastomers in brake hoses, fuel hoses, air ventilation hoses, elastomer/metal parts in the chassis applications, and engine mountings containing up to 0.5 % lead by weight | As spare parts for vehicles put on the market before 1 July 2006 |
| 7(c). Bonding agents for elastomers in powertrain applications containing up to 0.5 % lead by weight | As spare parts for vehicles put on the market before 1 July 2009 |
Action Required:
